Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and IntuitiveSBA (a product of Goad Technologies) ("IntuitiveSBA", "we", "us"). By creating an account or using the IntuitiveSBA app or website (the "Service"), you agree to these Terms. If you use the Service on behalf of a school, you confirm that you are authorised to bind that school to these Terms.

2. Accounts and eligibility

• The Service is intended for schools in Ghana and their authorised staff (teachers, heads and administrators).
• You must provide accurate information and keep your sign-in credentials confidential.
• You are responsible for activity under your account. Tell us promptly if you suspect unauthorised access.

3. The Service

IntuitiveSBA helps schools turn marked scripts into report cards: the app reads scores from sheets you photograph, applies SBA scaling and GES grading, computes aggregates and positions, drafts remarks, and can send report links to guardians by SMS. Score capture works offline and syncs when you reconnect. The Service uses automation and AI to assist your work — results are aids that your staff must review before use.

4. School responsibilities and data protection

• Where you enter or upload pupil and guardian data, your school is the data controller and IntuitiveSBA acts as your processor on your instructions.
• You confirm that you have a lawful basis to process the pupil and guardian data you put into the Service, including any consents your policies or the law require.
• You are responsible for the accuracy of the data you enter and for only sending messages to guardians who have consented.
• You will use the Service in line with our Privacy Policy and applicable law, including the Data Protection Act, 2012 (Act 843).

5. Acceptable use

You agree not to:

• Use the Service unlawfully or upload data you are not authorised to process.
• Attempt to access another school's data, breach security, or interfere with or overload the Service.
• Reverse-engineer, copy or resell the Service except as the law expressly permits.
• Use the Service to send unsolicited messages or to harass any person.

6. AI-assisted output

Score extraction and draft remarks are produced by automated systems and may contain errors. You are responsible for reviewing and correcting them before issuing report cards. IntuitiveSBA does not guarantee the accuracy of AI-generated output and it must not be relied on as the school's final judgement without review.

7. Fees

Your use of the Service is on the plan agreed with your school (which may currently be a free or pilot plan). We may introduce or change fees in future and will give reasonable notice before any charges apply to you.

8. Intellectual property and your data

We own the Service and all related software and materials. Your school keeps ownership of the data it puts into the Service. You grant us a limited licence to host and process that data solely to provide and support the Service, as described in our Privacy Policy.

9. Third-party services

The Service relies on third parties, including our AI provider and SMS gateway. Their availability is outside our control, and your use of features that depend on them is also subject to their terms.

10. Availability and changes

We work to keep the Service reliable but provide it on an “as is” and “as available” basis. We may update, change or discontinue features, and we may carry out maintenance that temporarily affects availability.

11. Suspension and termination

We may suspend or terminate access if these Terms are breached or to protect the Service or its users. You may stop using the Service and delete your account at any time (see our Account & Data Deletion page). Deleting a staff account does not delete the school's records, which remain with the school as the data controller.

12. Disclaimers

To the maximum extent permitted by law, we disclaim all warranties not expressly stated here, including fitness for a particular purpose and uninterrupted or error-free operation. The Service supports, but does not replace, the professional judgement of school staff.

13. Limitation of liability

To the maximum extent permitted by law, IntuitiveSBA will not be liable for indirect, incidental or consequential losses, or for loss of data or profits, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnity

You agree to indemnify IntuitiveSBA against claims arising from your misuse of the Service or your processing of personal data without a lawful basis or required consent.

15. Governing law

These Terms are governed by the laws of the Republic of Ghana, and disputes are subject to the jurisdiction of the courts of Ghana.

16. Changes to these terms

We may update these Terms from time to time. The effective date above shows when they last changed, and continued use of the Service after a change means you accept the updated Terms.
